Ningxia launches targeted legal campaign to boost corporate compliance in environmental protection

The Ningxia Hui autonomous region has recently launched a month-long targeted legal publicity campaign focused on strengthening corporate compliance in environmental protection at industrial parks across the region. Throughout June, judicial administrative organs and legal publicity institutions at all levels in Ningxia will provide industrial enterprises with a "customized package" of themed legal publicity activities.

The campaign targets enterprises with major pollutant discharge, high energy consumption, and high emissions, as well as those undergoing rectification following ecological inspection.

Addressing the pain points and blind spots in enterprises' environmental management, the campaign centers on the Ecological and Environmental Code, with a particular emphasis on interpreting the criteria for determining illegal acts such as unlicensed pollutant discharge and falsification of monitoring data, as well as their legal consequences. It also explains relevant laws through typical law enforcement cases, guiding enterprises to establish routine environmental compliance management systems to prevent recurrence of similar problems at the source.

Recognizing discrepancies among some enterprises in standard adherence and rectification outcomes, the campaign clarifies the legal basis for rectification and the specifications for acceptance, helping them improve long-term management and control mechanisms.

In terms of fiscal and tax compliance, the campaign delves into the Environmental Protection Tax Law. Tax professionals provide hands-on demonstrations of procedures for tax data collection and reporting, focusing on high-frequency risks such as inconsistencies among pollutant discharge permit data, online monitoring data, and tax declaration data. They guide enterprises to establish mechanisms for regular reconciliation of environmental, fiscal, and tax data to effectively mitigate tax-related legal risks.

Meanwhile, ecological and environmental law enforcement officers address businesses' concerns about inspection frequency, discretionary benchmarks for penalties, and applicable conditions for reduced or waived penalties, strengthening the integration of law enforcement and legal publicity.

The campaign adopts a combination of thematic lectures and on-site consultations, providing customized guidance for enterprises at various industrial parks across the region according to different industry sectors. For key enterprises with prior environmental violations or unresolved rectification issues, the campaign provides one-on-one on-site assistance to refine their environmental ledgers.

Judicial administrative organs at all levels across Ningxia will also establish two sets of ledgers — one for enterprises' legal needs and the other for problems to be rectified. Through checklist-based management, closed-loop rectification, and follow-up effectiveness evaluations, the campaign aims to translate the results of legal publicity into tangible outcomes of law-based and compliant operation for enterprises.
